I would like every licensed electrologist to take pride in believing in the ethics of proper hair removal. The last ten years have been an ongoing struggle for electrologists as we struggle to take back our profession from certain unethical "laser operators".


With the advent of the internet, advertising our business has completely changed from the outdated phonebooks to websites and blogs on the internet. Since the inception of laser hair removal, many devious predatory advertising tactics have been used by certain dishonest "laser operators" upon the "electrolysis profession". These few unscrupulous "combination electrologist /laser–operators" harass, besiege and single out the honest, hard-working electrologists. So far the law has not caught up with the blatant misuse of these wild west tactics used by some very unscrupulous individuals who, it seems, by their very efforts to discredit others in their profession, have no pride in their industry.

 

We ethical electrologists are well aware of the few electrologists who turned their backs on our chosen profession to become "dishonest electrologist/ laser operators".

 

These misguided turncoats to our chosen profession signed long-term ironclad leases for their state of the art "Looney -Tunes Duck Dodgers 24TH Century Laser Hair Removal Gadgets and Gizmos." The laser parlor industry was and still is desperate for the least bit of recognition. So they have sought out the less skilled and unethical licensed electrologists to become laser operators. Nonetheless, out of the 853 licensed electrologists in Massachusetts, only 10 to 15 use laser. Professionally speaking, I do not shed one tear for the "combination electrologist/ laser operators" who are locked into their ironclad contracts from $500.00 to $5000.00 per-month. They have become willing partners in temporary laser hair removal scams from the day they signed their leases, for they knew that laser hair removal was a total failure, temporary at best and dangerous to say the least. Yet in these hard economic times our "electrologists/laser operators" are putting the old squeeze on the last remaining uninformed consumers while deceptively advertising under the disguise of Boston Electrolysis®.  The resurgence of electrolysis has hit laser parlors and "combination electrologists/laser operators" right where it hurts, in their pocketbooks. After 14 years and counting, American consumers have wised up to the fact that laser hair removal is temporary and a scam.


The Primary Goal Of The Laser Parlor Industry


I will never forget when laser operators first came on the scene. They said that their "primary goal was to put the electrolysis profession out of business." Well here it is 2009 already and that has not happened, yet we find that the tables have now turned and the last remaining "combination electrologist/laser operators" are in a quagmire of deep financial trouble. These remaining unethical "electrologists/laser operators" have brazenly defied laws and professional ethics and rules and regulations that were enacted to protect the consumer in order to remain financially viable. In this recession, they have become frantic, finding themselves stuck with expensive leases, and have turned to advertising illegally under the electrolysis label using their old bait and switch scams. Some of them actually steal and infringe upon honest, hard working electrologists by outright internet piracy of their federally trademarked business names, stealing the identity of honest electrologist's intellectual property.

Oh, how the high & flighty have fallen! When the laser operators first came out they predicted the end of the electrolysis profession but now they have become the down and out "combination electrologist/laser operators" set for failure. It is they who are financially strapped and locked into their leases with no way out other than bankruptcy or reneging on their expensive monthly leases which could devastate them financially, destroy their business or, at the very least, damage their credit rating.


I Call Them "The Born Again Electrologists!"


There are a few who have truly repented and many "electrologist/laser operators" have had a religious awakening after having their hands caught in the cookie jar. Most have seen the light, repented and reputed temporary laser hair removal, and then quietly dusted off their outdated electrolysis epilators to replace or supplement their fading laser parlor revenues. Many of them have become self-righteous "born again electrologists" who preach the almighty true blue gospel of electrolysis as the only known method that achieves permanent hair removal. They hide their past shame and sinful ways along with their lasers in the closet with the rest of their skeletons like no-needle-electrolysis, transdermal electrolysis, Kalo Hair Growth Inhibitor and other various quack products.


Who Am I?


Boston Electrolysis® websites (Bostonelectrolysis.com, Bostonelectrolysis.net, Bostonschoolofelectrolysis.com and Boston-electrology.com) are about 1,000 cyber-pages of hard work. For over 10 years I have labored long hours and invested thousands of dollars and over 3500 computer hours of my time so the public has the opportunity to read and learn about electrolysis.

I started my successful practice while living in Boston and have worked hard ever since to maintain the integrity and credibility of my business and professional reputation as a Massachusetts Licensed & Registered Electrologist. When I moved my life and practice to Scottsdale, Arizona I exercised what I took to be my right to move the business that I built with me. I have continued to build my practice and develop my websites as a free educational resource for consumers.

In 1991, I relocated to the Great State of Arizona for health reasons and for its beautiful, warm, sunny climate where "western hospitality" abounds with warm-hearted, friendly people and the vast, beautiful, open spaces and big sky of the west. Then again, being a Bostonian at heart and missing Boston just a tad bit here and there, is the reason why I named my practice Boston Electrolysis® and purchased all the Boston Electrolysis® domains (www.Bostonelectrolysis.com and www.Bostonelectrolysis.net.) However, it's my hard work that has made Boston Electrolysis® a successful professional establishment and its websites are the internet's biggest and best that take a stand against the scams of temporary laser hair removal and the "electrologists/laser operators."

The fact that I possessed the business intuition, foresight and good luck to be at the right place at the right time when I purchased all the Boston Electrolysis® domains also left me with the challenge of dealing with certain unethical bottom-dwellers who like to claim they are associated with me by illegally using my trademarked business name, Boston Electrolysis®, for their personal gain.

Without one doubt there is only one Boston Electrolysis® and Boston School of Electrolysis, founded and owned soley by me, with the domain names of Bostonelectrolysis.com, Bostonelectrolysis.net and Bostonschoolofelectrolysis.com.  

My notable scholastic achievement is my lecture series at Harvard Medical School from 1983 to 1987 on the subjects of electrolysis, endocrinology, and human sexuality and a smattering of psychology.

Who Are They?


There are no "ifs, ands or butts", in my opinion, in thinking that the "combination electrologist/laser operators" are the antithesis of what an electrologist should be. With their complete lack of professionalism and disrespect for their colleagues, they continue to plunder their peer's practices with such fervor, using illegal, devious and deceptive internet advertising tactics. There are some faithful electrologists, whose practices are now thriving, who weathered this storm, but a few remaining desperate "electrologists/ laser operators" are still using illegal "search engine optimization tactics" to steal traffic from honest, hard-working electrologists' brand name websites. One particular "electrologist/laser parlor operator" composes and posts a plethora of her own testimonials on Merchantcirlce.com, Citysearch.com, Citysquares.com, Yellowbot.com, Yelp.com and all the local Boston websites, but as you read them and compare the writing style, one realizes how they all sound like the same writer. The example I use here is Pour Le Corps:

Patrice J. Oneill is the owner of Pour Le Corps (French for "for the body"), a skin & laser parlor located at Clarendon Street, Boston, Massachusetts, 02116 with her webmaster brother, Sean Patrick Oneill, of 38 Pilgrim Road, Holliston, MA, 01746, Phone 617-332-9205. Both are in the top running to be the first members of my Boston Electrolysis Wannabe Fan Club. Patrice J. Oneill of Pour Le Corps, a Boston Day Spa, is a blatant illegal trademark infringer of Boston Electrolysis®. He deceives and misdirects the consumer away from locating quality Massachusetts licensed & registered electrologists who are listed in the directory of Boston Electrolysis Yellow Pages.


The Boston Electrolysis® Wannabe Fan Club


Because of these nefarious schemes being perpetrated upon the innocent electrologist, I have created the Boston Electrolysis® Wannabe Fan Club© for the intellectually deprived jealous down and outers known as "combination electrologist/laser operators" who illegally advertise as Boston Electrolysis. People who use, leech, abuse and infringe another person's intellectual property rights and creativity actually learn to believe their own lies. Some call it jealousy, some call it envy, but in my book it's just plain thievery and I believe it's the parents' fault for sparing the rod when they caught their daughter or son stealing that candy-bar or going through mom's pocketbook or dad's wallet when they were younger.


My Complaint Is Twofold


You ask "What is the Boston Electrolysis® Award©?

Some "combination electrologist/laser parlor operators" have become quite creative in their thievery, such as the example below:

The Boston Electrolysis® Award is a complete hoax fabricated by Patrice J. Oneill, an electrologist/laser parlor operator and owner of www.Pourlecorps.com.

In reality, the award is known as the Best of Boston Award recipient from Boston Magazine. However, the use of the term BOSTON ELECTROLYSIS® that she herself posted, pat on the back, is an ILLEGAL violation of a registered and trademarked name and is the intellectual property of its owner, as she well knows, and is an infringement upon the owner's legal rights. While Patrice J. Oneill of Pour Le Corps claims to have won Boston Magazine's award for permanent hair removal services, I Googled "Boston Magazine's award for permanent hair removal service" and there is no such award.

Patrice J. Oneill, owner of Pour Le Corps, still claims to be the winner of The Boston Electrolysis® Award. Now you would think that, since I am the owner and founder of Boston Electrolysis®, I would know if I gave Patrice J. Oneill, or her business Pour Le Corps, the Boston Electrolysis® Award©. I assure you I never did because I never created it. However, if I could give Patrice J. Oneill and her webmaster brother, lady boy Sean Patrick Oneill an award, it would be "The Pinocchio Award for Telling Tall Tales & Whopper Lies" for their false claims and fabrication of the "The Boston Electrolysis® Award©". I believe this is their way of saying they are jealous that I own Boston Electrolysis®. But if Patrice J. Oneill wants real success there is only one way to achieve it - that is with honesty, hard work and taking pride in what you do. Most important is respecting other people's property. Patrice J. Oneill only humiliates herself in public when she infringes on my trademark, Boston Electrolysis® .

In a previous conversation Sean Patrick Oneill, who was acting like he owned Pour le Corps, informed me that Day Spa Pour Le Corps in 1996 won the Best of Boston Award from Boston Magazine and it is not the Boston Electrolysis® Award! In my opinion this is a onetime award given to customers for spending the most money advertising with Boston Magazine. Since then they have not won again.

Pour Le Corp, aka www.pourlecorps.com, has fabricated this lie, "The Boston Electrolysis Awards", and it sounds like Pour Le Corps actually received an award from me, Boston Electrolysis®. After that, their internet listing reads, "Boston Electrolysis® and Laser Hair Removal Best of Boston Electrolysis® Award Recipient" which is a gross fabricated lie. BELOW IS A FAKE BOSTON ELECTROLYSIS® AD BY POUR LE CORPS

Illegal Use Of My Trademarked Business Name Boston Electrolysis®


As you can see in the example above, Patrice J. Oneill, of Pour Le Corps and her brother, Sean Patrick Oneill, openly and illegally use my federally trademarked business name, Boston Electrolysis®. Their website, www.pourlecorps.com, is indexed by search engines and Pour Le Corps is posted close to or next to my website, www.BostonElectrolysiscom. In addition, Patrice J Oneill and her brother, Sean Patrick Oneill, have inserted "Best of Boston Electrolysis Award and Laser Hair Removal Best of Boston Award Recipient" on their website which makes them appear in the Boston Electrolysis search listing results. Nonetheless, when you click on it you are illegally redirected to their site, www.pourlecorps.com. On the internet this is illegal and is known as "page jacking, domain squatting, bandwidth identity theft" and more violations, too numerous to list. Of course, Patrice J. Oneill and webmaster brother, Sean Patrick Oneill, have resorted to advertising as Boston Electrolysis on Google Ads now as well.

This envious imitator and Boston Electrolysis® Wannabe©, Patrice J. Oneill, has the impudence to illegally advertise that they are part of Boston Electrolysis®. I asked the owner, Patrice J. O'Neill, to please respect my intellectual property rights and my business name, Boston Electrolysis®, which they illegally inserted into their website in approximately 2007.

Because of their non-compliance with my honest and respectful initial request to remove all references to my trademarked name, BOSTON ELECTROLYSIS®, I posted the following disclaimer:


First Boston Electrolysis® Disclaimer & Consumer Public Notice

A Boston based laser parlor and skin care salon known as Pour Le Corps Day Spa is illegally advertising as Boston Electrolysis. Their fraudulent use of my identity and trademarked business name," Boston Electrolysis", on the internet is obvious and is on its website, www.pourlecorps.com, without my written authorization. It is my professional opinion that their willful theft and infringement of my intellectual property, Boston Electrolysis®, is done to attain new clients and obtain a better ranking from my top rated educational websites, www.bostonschoolofelectrolysis.com and wwww.Bostonelectrolysis.com, which are the largest and most informative educational electrolysis websites on the internet regarding quality electrolysis. Boston Electrolysis® carries factual reports on the slippery downside and dangers of radioactive emitting temporary laser hair removal.

At the end of this article please find copies of Pour Le Corp's actual theft and their listing where they claim and state to be the following, "Boston Electrolysis Award and Laser Hair Removal Best of Boston."


In my conversation with Patrice's webmaster brother, Mr. Sean Patrick Oneill, he expressed his jealousy and covetousness of my ownership of Boston Electrolysis by saying that, because I reside in Arizona, I do not have the right to own and use the name Boston Electrolysis® even though I own the federal trademark. He additionally accused me of monopolizing my own business name, Boston Electrolysis, further adding in his "poor wittle me" tone of voice, "I know what you're trying to do, you're trying to monopolize all the Boston Electrolysis internet pages." Well, I replied, "I am guilty of promoting my own business name which really is none your business, Mr. Sean Patrick Oneill". However I might ask this question, "Sean, how come you monopolize Pour Le Corp, AKA www.Pourlecorps.com on Google and don't you think that's most unfair to the poor French people who live in France, as you and your sister do no business there?"


Now I find that Sean Patrick Oneill, the webmaster for www.pourlecorps.com and www. www.oneillindustiressllc.com, and his sister, who both have carpal tunnel syndrome from tipping their wrists at Paddys Irish Pub, also aspire to lift their wee leprechaun- touched Gallic status beyond their bar stools that have grown weak and wobbly by the odorous air that continually surrounds them. They vehemently espouse their claim to fame, and their desire to be "devout avid ultra Francophiles" but don't see that they live in a glass house of their own making with such a foggy view of their own life that they can't see the same "log in their own eye" for how they unfairly monopolize the French and others by unfairly using the non-trademarked name Pour Le Corps.


Nonetheless, how could an electrologist in Boston pick a name like Pour Le Corps in America's most patriotic city, Boston, Massachusetts, home of the American Revolution?  Yes, Boston Electrolysis® is an excellent name for an electrologist's practice; nonetheless it took years of hard work writing educational articles and making Boston Electrolysis®, Boston School of Electrolysis, www.bostonschoolofelectrolysis.com, Boston Electrolysis® and www.bostonelectrolysis.com known and recognized as brand names. But I know for a fact that if Patrice J. Oneill worked as hard as I do and wrote some copy, she could turn Pour Le Corps (also known as ww.pourlecorps.com) into a recognized website. It's obvious she will not take the time and investment to make www.pourlecorps.com a success when all she has to do is steal and infringe my Boston Electrolysis® trademark. Furthermore, when I politely asked Patrice J. Oneill to remove Boston Electrolysis from her website, www.pourlecorps.com, she advised me to speak with her attorney, Anne Cushing of Dolan & Cushing Boston, MA. After conversing with Ms. Cushing, it was she who stated that she does not represent Patrice J. Oneill as her attorney. Now, I ask, how could anyone trust someone who steals and infringes another person's business name, professional reputation and trademark?

In a recent telephone conversation I had with Patrice J. O'Neill, owner of Pour Le Corps, a laser parlor salon claiming to be a day spa operating at Clarendon Street Boston, Massachusetts, I confronted her with her illegal use of my trademarked business name, Boston Electrolysis®and my educational websites, Boston Electrolysis® & Boston School of Electrolysis. I may be old-fashioned but I believe that one earns a right to one's intellectual and professional property through years of dedication and hard work such as I have invested into my practice, as I have mentioned earlier in this article.

Patrice J. Oneill of Pour Le Corps refuses to understand that Boston Electrolysis® websites, Bostonelectrolysis.com, Bostonelectrolysis.net, www.Bostonschoolofelectrolysis.com and www.boston-electrology.com. represents hours of my hard work to create and maintain and inform intelligent consumers of the benefits of electrolysis. Contrast that with the slanted type and hype of the unethical businesses and advertising practices done by disreputable "combination electrologists/laser operators" who twist and torment the truth into lies because they are too lazy to sit down and actually write their own copy, yet cry foul when they find themselves facing retaliation.


Trademark infringers are thieves and people like Patrice Oneill know full well that I do not accept electrologists that use laser on my Boston Electrolysis® Yellow Pages  because I know temporary laser hair removal is a scam. Patrice Oneill thinks my trademarked business name is what brings my success when it's really my hard work that she lives off like an internet leech AKA trademark infringer. In my opinion, Patrice Oneill has no respect for my hard work that has made Boston Electrolysis® successful. However, I believe that if she applied just a little sweat and hard work herself she could make an offbeat and weird business name like Pour Le Corps, also known as www.Pourlecorps.com, a success. It is my opinion that she has an aversion to doing an honest day's work and steals and infringes my trademark, Boston Electrolysis®, for her personal gain. One has to wonder how she runs her brick and mortar business.

I wish they would refrain from stealing and inserting my trademarked business name, Boston Electrolysis®, in their website, www.pourlecorps.com. Many times I have politely requested that Patrice Oneill, owner of Pour Le Corps, not to use my business name and the professional reputation of Boston Electrolysis to seek new clientele for her economic woes.

Boston Electrolysis Yellow Pages


Three years ago I created the Boston Electrolysis Yellow Pages on www.Bostonelectrolysis.com, which is Boston's only and largest "No Laser Directory" of Massachusetts Licensed & Registered Electrologists. In the Commonwealth of Massachusetts there are approximately 853 practicing Massachusetts Licensed & Registered Electrologists alone.


Boston Electrolysis® takes a professional pride in its stand against temporary laser hair removal and only lists licensed & registered electrologists on it as the greedy, less skilled "combination electrologists/ laser operators" and the hard core laser operators who try to dominate and push the electrologists off the Internet Electrolysis Pages do not deserve a helping hand - that would only encourage their miscreant ways further.


The FDA Statute and Law

The FDA Food and Drug Administration statutes say that laser manufacturers should be aware that receiving FDA clearance for general permission to market their devices does not permit them to advertise their lasers for either hair removal or wrinkle treatment, even though hair removal or wrinkle treatment may be a by-product of any cleared laser procedure. Further, manufacturers may not claim that laser hair removal is either painless or permanent unless the FDA determines that there are sufficient data to demonstrate such results. Several manufacturers received FDA permission to claim, "permanent reduction," NOT "permanent removal" for their lasers. So do the math and add the facts with your common sense and then compare electrolysis as the only known treatment for safe, permanent hair removal approved by the FDA. After you have done your tally you will discover that, at best, the radiation-emitting laser is temporary and dangerous in addition to being a non-licensed, non-regulated industry. This leaves your licensed and registered electrologists who do not use the laser as your best and only choice for safe, permanent hair removal.

Using the link below you can visit for yourself and read the FDA page with the statute that states that laser parlors cannot advertise nor claim permanent or painless hair removal in any form or manner - period.

You can read on the Pour Le Corps website that they claim permanent hair removal with the laser which violates FDA statutes and the law that states that laser parlors and laser operators may not advertise or claim permanent hair removal in any form or manner not approved by the FDA. Additionally, they may not claim painless hair removal.


Laser Hair Removal Refunds

Consumers beware – most, but not all, small claims courts will rule that, if you have had Laser Hair Removal and the owner of the laser parlor stated in writing that it was permanent hair removal, then most likely you will get your money back in a small claims court if you kept a copy of the advertisement from their publication or from their website.

If you did not achieve permanent hair removal with your treatment at Pour Le Corp or any other laser parlor who gave you a written guarantee, you should apply for a refund. If they refuse, take a copy of their website advertisement where they claim permanent removal to the court and you will have a good chance for a full refund - but of course I cannot guarantee that.

Laser Hair Removal Is Dangerous and causes "Melanoma"!
Additionally, it is my firm belief the ultraviolet radiation emitted from laser hair removal equipment is dangerous and can cause A-melanoma one of the most deadly skin cancers with no pigment. The laser used in temporary hair removal lightens moles and dangerous skin cancer lesions are difficult, if not impossible, to detect if dangerous melanoma until it's too late.

Furthermore, after 14 years on the market, temporary laser hair removal has not proven itself to be permanent and 100% safe like electrolysis and that is why FDA statutes and law stipulates and prohibits laser parlor salons and their operators from advertising, "permanent hair removal".


Infringement of Rights Issues


Pour Le Corp's blatant theft and willful infringement of my trademarked business name, Boston Electrolysis® constitutes infringement on my intellectual property and is punishable by law. By using hidden meta-tags and trade names they are able to get better search engine ratings and if they use the trademarked business name, Boston Electrolysis® in their meta tags, they are sure to get those first page listings from the search engines as Boston Electrolysis® has high rankings !

There has been a lengthy debate about whether a competitor's trademark, when used as a meta-tag or is elsewhere hidden on a website or web page, constitutes a willful infringement of that competitor's trademark. A recent first circuit court of appeals decision ruled and says it does! (See Venture Tape Corp. v. Mcgills Glass Warehouse.)

Boston Electrolysis® has given notice!


Federal Trademark for Boston Electrolysis®!
Boston Electrolysis has completed and has been awarded its federal trademark. If you're a violator using Boston Electrolysis without authorization you are a thief, which is punishable by law!

Something that Pour Le Corps Day Spa and other trademark violators need to know is that "willful" trademark infringement is a theft. This raises the ante considerably that a violator will be brought to the attention of the public. The fines and penalties for trademark violation, ranges up to $1 million per violation. Additionally, the public humiliation one would endure would damage what's left of their business considerably. A favorable judgment against them also would inform the public to beware of how Patrice J. Oneill, owner of Pour Le Corps, runs her overall business.

Intelligent business owners and educated consumers know that trademarks are powerful tools for protecting their business name and professional status. Don't let "Boston Electrolysis® Wannabes©" fool you with hidden meta tags. Trademark violators are thieves risking their financial status and resources. Furthermore, they have lost their respectability and credibility and standing in the professional community for their obvious disrespect of the law.


How Do They Do It?


The cited sample Pour Le Corps listing on Yahoo clearly shows where they inserted Boston Electrolysis® at the beginning of the third line down. In my opinion, the way this ad reads clearly deceives the consumer into thinking that this search listing is Boston Electrolysis® or is approved by, or at least associated with ,Boston Electrolysis®. This is a total fabrication and a lie. One must contemplate why Patrice J. Oneill cannot distinguish right from wrong when she illegally advertises as Boston Electrolysis®


Why Do They Do It?

Why do laser operators always advertise under electrolysis?
